Brenn- und Kaminholz

Terms and conditions

This translation is provided for information only. The legally binding version is the German one. Read the German version

§ 1 Scope and contracting party

These General Terms and Conditions apply to all orders placed via the online shop brenn-und-kaminholz.shop. Your contracting party is Brenn- und Kaminholz-Service Hochspeyer, Hauptstraße 207, 67691 Hochspeyer (“we”). Deviating terms of the customer only apply if we expressly agree to them.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code).

§ 2 Conclusion of the contract

The presentation of products in the shop is not a legally binding offer but an invitation to order. By clicking the “Place order with obligation to pay” button, you submit a binding offer to purchase the goods in your cart. You can check and correct your details at any time before submitting.

Immediately after ordering, you receive an automatic email confirming receipt of your order. This is not yet an acceptance. The contract is concluded when we confirm your order by email or phone within three working days, or at the latest upon delivery of the goods.

The language of the contract is German. We store the text of the contract; you receive the order details and these terms by email. You can view these terms on this page at any time.

§ 3 Prices and quantities

All prices are final prices in euros and include statutory VAT. Delivery costs depend on the delivery postcode and the quantity ordered and are shown before you complete your order.

Quantities in stacked cubic metres (RM) refer to neatly stacked wood including the gaps. Loosely delivered wood takes up more space (1 RM corresponds to about 1.4 loose cubic metres). Wood is a natural product; minor variations in log length, thickness and colour are not a defect.

§ 4 Delivery

We deliver within Germany to the delivery address provided. You specify your preferred delivery date when ordering; we agree the exact day and a time window with you by phone or email.

You ensure that the unloading spot can be reached by a truck, with firm ground and sufficient width. Please state any special features of the access when ordering. If delivery is not possible for reasons for which you are responsible, we may charge the cost of the wasted journey.

Further details can be found under Delivery & payment.

§ 5 Payment

The following payment methods are available: Bank transfer in advance, Cash on delivery and Pay by invoice.

  • Bank transfer in advance: you transfer the full amount after ordering, without surcharge. We schedule delivery once payment has been received.
  • Cash on delivery: after ordering, you transfer a deposit; you pay the balance in cash to the driver on handover.
  • Pay by invoice: after ordering, you transfer a deposit; we invoice the balance after delivery, payable within 14 days without deduction.

The deposit consists of the delivery costs (including crane unloading, if selected), the surcharge and one third of the value of the goods. For payment on delivery or by invoice, we charge a surcharge of 0 % of the delivery costs. The deposit, surcharge and balance are shown separately before you complete your order. We schedule delivery once the deposit has been received.

§ 6 Retention of title

The goods remain our property until paid for in full.

§ 7 Liability for defects

The statutory provisions on liability for defects apply. The stated residual moisture refers to measurement on a freshly split surface at the time of delivery. Please store the wood in a dry and airy place after delivery, as it may otherwise absorb moisture again.

§ 8 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy.

§ 10 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of their country of habitual residence. Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
